Last week, the UK unveiled its guidelines for overseeing the development and implementation of AI, prompting legal experts to caution that many organizations will likely turn to the proposed EU AI Act to ensure compliance with both regulatory frameworks.

The EU AI Act, which introduces a tiered system for bans, restrictions, and protective measures concerning the integration of AI technologies, received endorsement on February 13 from two crucial bodies within the European Parliament. Members of both the justice and single market committees approved a provisional agreement established late last year.

Seeking to carve its own path following its departure from the EU, the UK has issued “guidance” on navigating the complexities of AI implementation, intending to leverage existing legislation alongside a renewed emphasis from regulators. This approach, termed “light-touch” or “pro-innovation,” prioritizes outcomes.

According to the guidance, achieving these outcome-based objectives will entail existing regulatory bodies interpreting and enforcing the regulatory principles within their respective sectors, while also establishing clear directives for attaining these objectives within specific industries.

Nevertheless, given that much of the AI development and deployment activity in the UK is likely to intersect with EU regulations, businesses are expected to prioritize compliance with Brussels’ rules, operating under the assumption that adherence to London’s guidance will align accordingly.
